Governor also OKs legislation to cap attorney fees, use test results to fire teachers

Madison – Homeowners who shoot intruders will have new legal protections, under a bill signed Wednesday by Gov. Scott Walker.

The Republican governor also signed legislation to limit attorney fees in lawsuits – a bill that conservatives said would end frivolous lawsuits but which Democrats said also would end many lawsuits with merit.

Under the intruders bill, courts in most criminal and civil matters would presume that people using deadly force had acted reasonably against anyone unlawfully inside their residence, business or vehicle, whether the trespasser was armed or not.

The proposal is sometimes known as the “castle doctrine,” a reference to the saying that one’s home is one’s castle. The bill passed the Senate and Assembly on bipartisan votes last month.

The legislation is one of 21 bills that Walker signed privately Wednesday after they were passed by the Republican Legislature in October and November.

“By signing the castle doctrine into law, I am standing with those individuals who chose to protect their family and property,” Walker said in a statement.

On Nov. 1, Wisconsin became the 49th state in the country to allow people to carry concealed firearms.

A D.C. Superior Court jury on Monday found Ingmar Guandique guilty of first-degree murder in the slaying of former federal intern Chandra Levy.

The jury of nine women and three men reached its verdict after 3 1/2 days of deliberations.

The verdict was a major victory for the U.S. attorney’s office in the District.

The Levy case was challenging for the prosecution from the start. There was no forensic evidence linking Guandique to the crime scene; no murder weapon; no eyewitness; and no definitive ruling from the medical examiner on what killed Levy. Numerous mistakes by police and forensic scientists further hampered the investigation.

U.S. issues travel alert for Americans in Europe as terrorism threat grows

The State Department issued a “travel alert” Sunday, cautioning American travelers of potential dangers in Europe after what U.S. officials said was an assessment of information that al-Qaeda appeared to be plotting attacks on cities there.

The alert did not identify any particular countries and did not urge Americans to avoid particular venues. It was a step below a formal “travel warning,” a designation telling U.S. citizens to avoid traveling to particular places.

U.S. officials emphasized that Americans should not alter any travel plans because of the alert.

“We are not, repeat not, advising Americans not to go to Europe,” said Patrick Kennedy, the undersecretary of state for management. “We’re not saying don’t visit major tourist attractions or historic sites or monuments.”

He suggested that U.S. citizens register with embassies abroad, avoid civil disturbances and not discuss travel plans with others.

European authorities fell in line with the United States in urging increased caution. Britain raised its threat level for Germany and France to “high.” The threat level for England had been raised earlier to “severe.” Authorities in Europe have been warning for the past three weeks that the danger of a terrorist attack in Europe has been higher than usual, but they issued no specific information on what new intelligence has led them to ratchet up the alert level.

CIA sees increased threat from al-Qaeda in Yemen

For the first time since the Sept. 11, 2001, attacks, CIA analysts see one of al-Qaeda’s off-shoots – rather than the core group now based in Pakistan – as the most urgent threat to U.S. security, officials said.

The sober new assessment of al-Qaeda’s affiliate in Yemen has helped prompt senior Obama administration officials to call for an escalation of U.S. operations there – including a proposal to add armed CIA drones to a clandestine campaign of U.S. military strikes, the officials said.

“We are looking to draw on all of the capabilities at our disposal,” said a senior Obama administration official, who described plans for “a ramp-up over a period of months.”

The officials, who spoke on condition of anonymity to discuss intelligence matters, stressed that that analysts continue to see al-Qaeda and its allies in the tribal areas of Pakistan as supremely dangerous adversaries. The officials insisted there would be no letup in their pursuit of Osama bin Laden and other senior figures thought to be hiding in Pakistan.

Indeed, officials said it was largely because al-Qaeda has been decimated by Predator strikes in Pakistan that the franchise in Yemen has emerged as a more potent threat. A CIA strike killed a group of al-Qaeda operatives in Yemen in 2002, but officials said the agency has not had that capability on the peninsula for several years.

Gun rights extended by Supreme Court

WASHINGTON — The Supreme Court held Monday that Americans have the right to own a gun for self-defense anywhere they live, advancing a recent trend by the John Roberts-led bench to embrace gun rights.

By a 5-4 vote, the justices cast doubt on handgun bans in the Chicago area, but signaled that some limitations on the Constitution’s “right to keep and bear arms” could survive legal challenges.

Justice Samuel Alito, writing for the court, said that the Second Amendment right “applies equally to the federal government and the states.”

The court was split along familiar ideological lines, with five conservative-moderate justices in favor of gun rights and four liberals opposed. Chief Justice Roberts voted with the majority.

Two years ago, the court declared that the Second Amendment protects an individual’s right to possess guns, at least for purposes of self-defense in the home.

U.S., Pakistan make arrests in failed Times Square bomb attempt

A 30-year-old U.S. immigrant from Pakistan was arrested late Monday at John F. Kennedy International Airport in connection with a failed car bombing in Times Square, and a Pakistani intelligence official reported multiple arrests in that country Tuesday as investigators pursued leads overseas.

Faisal Shahzad, a recently naturalized U.S. citizen living in Shelton, Conn., was taken off an airliner bound for the Persian Gulf sheikhdom of Dubai in the United Arab Emirates about 53 hours after the attempted bombing, authorities said Tuesday.

Under questioning by federal agents, Shahzad implicated himself and “has provided useful information to authorities,” Attorney General Eric H. Holder Jr. told reporters Tuesday afternoon. He said Shahzad was initially questioned under a public safety exception to the Miranda rule and was cooperative. He said Shahzad was later read his Miranda rights and “continued talking.”

Although Shahzad was arrested after the plane he had boarded returned to the departure gate, Holder said there was never any danger that he would get away. Homeland Security Secretary Janet Napolitano said authorities could have ordered the plane to return to the airport if it had taken off.

Sales of newly built U.S. single-family homes fell for a fourth straight month to a record low in February, a government report showed on Wednesday, heightening fears of renewed weakness in the housing market.

The Commerce Department said sales fell 2.2 percent to a 308,000 unit annual rate from an upwardly revised 315,000 units in January.

Sales of existing homes fell for a third straight month in February, pushing sales down to the lowest level since last July. There is concern that the fragile housing rebound could falter, making it harder for the overall economy to recover.

 The National Association of Realtors said that sales of previously occupied homes dropped 0.6 percent in February to a seasonally adjusted annual rate of 5.02 million.

 The weakness in sales depressed prices, with the median home price dropping by 1.8 percent from a year ago to $165,100.
